1. General Information and No Investment Advice
CHARTON is a technology platform. It does not provide investment advice, financial advice, trading advice, portfolio management, or brokerage services. CHARTON is not a registered investment advisor or broker-dealer. Nothing on this platform constitutes a recommendation to buy, sell, or hold any financial instrument. Users are solely responsible for all trading and investment decisions.
2. Regulatory Status
CHARTON is not registered with any financial regulatory authority, including the U.S. Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), or any equivalent international body. CHARTON operates solely as a technology provider. Users are responsible for ensuring their use of the platform complies with all applicable laws and regulations in their jurisdiction.
3. Impersonal Technology and Publisher-Style Content
Any content, analysis, strategy concept, parameter variation, automated output, chart annotation, or market explanation generated or displayed by CHARTON is impersonal, general in nature, and provided as part of a technology tool. It is not tailored to your personal financial situation, objectives, account size, tax position, risk tolerance, or suitability, and it should not be treated as individualized investment, trading, commodity trading, or financial advice.
4. Trading Risk Disclosure
- Trading financial instruments involves substantial risk of loss.
- Markets are inherently volatile and unpredictable.
- Losses may exceed your initial investment, especially when using leverage.
- Leverage amplifies both gains and losses.
- Liquidity may be limited under certain market conditions.
- You may lose some or all of your invested capital.
- CHARTON does not guarantee profits or protection against losses.
5. Futures, Forex, Derivatives, and Leveraged Products
Futures, forex, CFDs, options, margin products, perpetual swaps, and other leveraged or derivative instruments involve additional risks, including rapid losses, liquidation, margin calls, exchange or broker rule changes, gaps, unavailable liquidity, forced position reductions, and losses that may exceed deposited funds. CHARTON is not registered as a commodity trading advisor, futures commission merchant, introducing broker, forex dealer, or similar intermediary, and does not provide commodity trading advice.
6. Crypto Asset Risk
Crypto assets and digital asset markets may be extremely volatile and may involve technological, custody, regulatory, counterparty, protocol, smart-contract, exchange, stablecoin, bridge, and wallet risks. Crypto markets may trade continuously and may experience sudden liquidity failures, outages, delistings, or regulatory restrictions. CHARTON does not custody crypto assets and does not guarantee the availability, legality, or suitability of any crypto market.
7. Eligibility, Jurisdiction, and Sanctions
You may use CHARTON only if you are legally permitted to do so in your jurisdiction and are not subject to applicable sanctions, embargoes, or restricted-party rules. You are responsible for confirming that your use of CHARTON, any connected broker, and any trading activity is permitted where you live or operate. CHARTON may restrict or suspend access where required by law, sanctions programs, broker requirements, or internal risk controls.
8. No Guarantee of Performance
Any performance metrics, historical data, or simulated results displayed on the platform are provided for informational purposes only and are not guarantees of future performance. Past performance of any strategy, algorithm, or system is not indicative of future results. No representation is made that any user will or is likely to achieve profits or losses similar to those shown.
9. Backtesting and Hypothetical Performance
Backtested and simulated results shown on the CHARTON platform are hypothetical and have inherent limitations. Hypothetical or simulated performance results have not been prepared from actual trading and do not represent actual trading in any account. Because they are prepared with the benefit of hindsight, they may not reflect the impact of financial risk, changing market conditions, order execution, or the ability to follow a strategy in live markets.
- They do not reflect actual trading and may not account for real-world factors such as fees, spread, slippage, latency, liquidity constraints, rejected orders, partial fills, or execution delays.
- Hypothetical performance results are generally prepared with the benefit of hindsight.
- No representation is made that any account will achieve results similar to those shown.
- Backtested results may reflect over-optimization (“curve fitting”) to historical data.
10. Strategy Discovery, Turbo Scan, and Parameter Variations
Features such as Turbo Scan, strategy discovery, AI-generated strategy candidates, Strategy Variations, parameter comparisons, and Marketplace templates are historical research tools only. They may search, rank, or compare configurations using past market data, but they do not provide investment advice, trading recommendations, suitability determinations, or predictions of future performance.
- Historical candidates may be overfit to the tested period and may fail in live or out-of-sample markets.
- Metric changes such as win rate, profit factor, drawdown, or net profit are hypothetical diagnostics, not promises or targets.
- No candidate, ranking, comparison, or variation should be understood as the best, optimal, recommended, or most suitable strategy for you.
- Users are solely responsible for deciding whether to test, modify, deploy, or reject any candidate or variation.
11. AI and Automated Systems
- AI-generated outputs may be inaccurate, incomplete, or misleading.
- AI systems may produce unexpected or erroneous results, including so-called “hallucinations.”
- Users must independently verify all AI-generated strategies, conditions, and signals before deploying them in live trading.
- CHARTON does not warrant the accuracy, reliability, or suitability of any AI output for trading purposes.
12. Automated Trading and Agents
CHARTON provides Automated Agent functionality that may transmit Trade Execution instructions according to user-defined strategy parameters, execution mode, account permissions, and broker API settings. CHARTON does not decide whether a trade is suitable, does not exercise investment or trading discretion, does not monitor your account for suitability, does not manage your portfolio, and does not custody funds.
- Any automated activity is based on parameters and permissions you configure, approve, and remain responsible for.
- Misconfiguration of automated agents may result in unintended trading activity.
- Users are solely responsible for monitoring all automated trading activity.
- Users are responsible for disabling, pausing, or modifying automation when market conditions, broker rules, account status, or personal circumstances change.
- CHARTON is not liable for any trades executed or not executed by automated systems.
13. Broker Integration and Execution Risk
CHARTON does not execute trades directly, hold user funds, or act as a custodian. All trading is conducted through third-party brokers and exchanges connected through a Broker Account Connection. Users acknowledge that:
- CHARTON is not responsible for the actions, failures, or insolvency of third-party brokers or exchanges.
- Execution quality, order routing, order acceptance, partial fills, rejected orders, cancelled orders, duplicate orders, margin calls, liquidations, account restrictions, fund safety, and account availability are controlled by the connected broker or exchange.
- Broker APIs, authentication, rate limits, connectivity, market-data feeds, quotes, account data, and order systems may fail, delay, disconnect, or return inaccurate information.
- Users are responsible for all trading outcomes and for monitoring broker accounts, open orders, positions, margin, and account restrictions regardless of platform behavior.
14. Market Data Disclaimer
Market Data, prices, candles, quotes, indicators, account balances, positions, and other financial information displayed on the platform may not be accurate, complete, or real-time. Data may be delayed, subject to interruptions, sourced from third-party providers, derived from calculations, or affected by provider policies. Users must independently verify all data before making trading decisions. CHARTON is not responsible for losses resulting from reliance on inaccurate, stale, incomplete, unavailable, or delayed data.
15. Technology and System Risks
The CHARTON platform may experience outages, latency, connectivity failures, software bugs, or other technical issues. Technical failures may result in an inability to execute trades, cancel orders, or access account information, and may result in financial loss. CHARTON does not guarantee uninterrupted or error-free operation of the platform.
16. Third-Party Services
CHARTON integrates with various third-party services including data providers, brokers, exchanges, and infrastructure providers. CHARTON is not responsible for the availability, accuracy, or performance of any third-party service, and shall not be liable for any loss or damage arising from failures of third-party services.
17. Broker, Exchange, and Prop Firm Names
Broker, exchange, and prop firm names, logos, and trademarks shown on CHARTON are the property of their respective owners. Unless explicitly stated in writing, CHARTON is not affiliated with, sponsored by, or endorsed by those brokers, exchanges, platforms, or prop firms. Compatibility references are technical and informational only.
18. Testimonials and Examples
Any testimonials, case studies, trade examples, or performance screenshots shown on the platform or in marketing materials are for illustrative purposes only. They do not guarantee or imply that any user will achieve similar results. Individual results will vary based on market conditions, strategy configuration, risk settings, and other factors.
19. Limitation of Liability
To the maximum extent permitted by applicable law, CHARTON and its founders, officers, employees, contractors, and affiliates shall not be liable for any trading losses, loss of capital, loss of profits, loss of data, or any other direct, indirect, incidental, special, consequential, or exemplary damages arising from the use of or inability to use the platform.
20. User Responsibility
Users are solely responsible for all trading and investment decisions made using the CHARTON platform. Users are responsible for implementing their own risk management practices, understanding the strategies they deploy, and ensuring compliance with applicable laws. CHARTON does not supervise or oversee user trading activity.
21. Acceptance of Risk
By using the CHARTON Service, users explicitly acknowledge and accept all risks associated with trading financial instruments, including but not limited to the risks described in this disclosure. If you do not accept these risks, you should not use the platform.
